Terms of Service

You must be at least 16 years old and capable of entering into a binding contract. If you use Flaggity on behalf of a company, you represent that you have authority to bind that company.

• Free accounts allow limited monthly inspections and do not include certificate generation.
• Paid plans (Professional, Business, Enterprise) are billed monthly or annually through Stripe based on the rate in effect at the time of purchase.
• Monthly subscriptions auto-renew on the same day each month until cancelled.
• Annual subscriptions auto-renew on the same date each year. We'll send a reminder at least 15 days before renewal.
• Prices are listed in USD and exclude applicable taxes. We may change prices with 30 days' notice; the new price applies at your next renewal.

• You can cancel your subscription any time from Settings → Billing. Cancellation takes effect at the end of the current billing cycle. Your data remains accessible until then.
• Refunds are not issued for partial months, but we will honour a full refund if you cancel within 14 days of your first paid invoice and have not generated more than 10 certificates on the paid plan.
• Downgrading to a lower tier is allowed at the end of the current billing cycle. Features that exceed the new tier's limits (e.g., facilities, users) will be locked until you reduce usage.

You agree NOT to:

• Upload content you do not have the right to share, or that is illegal, obscene, or infringes someone else's IP.
• Reverse-engineer, de-compile, or circumvent any rate-limit or access control of the Service.
• Use the Service to build a competing product, or to scrape AI analysis results for resale.
• Share your account credentials. Each seat is for one named user. Team plans are metered per user.
• Misrepresent AI-generated findings as manually certified inspections. Certificates generated by Flaggity must disclose that AI analysis contributed to the assessment.

We may suspend or terminate accounts that violate these rules, with or without notice, and retain the right to keep audit logs of any violation indefinitely.

You retain ownership of all inspection photos, findings, reports, and other content you upload. You grant us a limited, worldwide, non-exclusive licence to host, process, and display that content only as needed to run the Service for you.

Reports and certificates that Flaggity generates from your content are yours to download, print, and distribute as you see fit. Flaggity does not claim copyright on your generated reports.

Flaggity's analysis is produced by Flaggity AI, our machine-learning inspection engine. We work hard to make it accurate, but AI output can be incomplete or wrong. Flaggity is an assistive inspection tool, not a substitute for a licensed inspector or engineer. You are responsible for reviewing every AI-generated finding before acting on it — particularly in safety-critical or regulated environments.

To the maximum extent permitted by law, Flaggity and its suppliers are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or in connection with the Service — whether in contract, tort, or otherwise — even if we were advised of the possibility of such damages.

Our total aggregate liability under these Terms is capped at the greater of (a) US $100, or (b) the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We may update these Terms from time to time. Material changes will be announced at least 14 days before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and Flaggity agree to submit to the exclusive jurisdiction of the courts located in Wilmington, Delaware for any dispute.
